Testamentary Vs. Inter-Vivos Trusts
There are two types of trusts: a testamentary trust (formally created through a deceased person’s will) and an inter-vivos trust, created by a settlor (individual) while alive. Beginning January 1, 2016, testamentary trusts are taxed at the individual highest marginal tax rate (except for GRE (Graduate Rate State) and QDT (Qualified Disability Trust)) while an inter-vivos trust (established after June 17, 1971) is taxed at the highest rate.
